The terms
of using TOM

Using this site means you accept what is on this page. It is short on purpose.

Last updated 27 October 2026, to describe the packs in full, the agreement before payment, and the service being open to everyone. Earlier versions are kept.

What TOM is

TOM reads the words of a pitch against a published rubric and returns an opinion: what would have disqualified it, what is weak, and how the same substance might be said in other rooms. It is feedback on a piece of writing. It is not advice about your business, your finances, your legal position or your fundraising, and it is not a prediction of whether you will raise money or win anything.

The read is written by an AI model. It can be wrong, it can miss things, and two reads of the same pitch can differ. It works only from the words you give it. It does not see your delivery or your presence, it does not know who you are, and it cannot check whether what you say is true. A read does not tell you how any listener, investor, judge or room will decide. What you do with it is your own decision.

TOM is for people aged 18 and over. By making an account or using the service you confirm that you are.

A young service

TOM PITCH is a young service. It may change, pause or stop, and features, prices and allowances may change. A pack you have already bought keeps what was described to you when you bought it. Your history, your scores and your notes are kept in your own browser, not by us, so they can be lost when the browser clears its data, when you change device, or in a private window. Keep your own copy of anything you need.

Recording yourself

When you record, the recording is made by your own browser and stays on your device. Record only your own voice. If anyone else can be heard, you are responsible for having their permission first. Where your browser writes your words down as you speak, it uses its maker’s speech service, under that company’s own terms.

What TOM is not, and the one rule we will not bend

Your content

What you write stays yours. You give us permission to process it for the single purpose of producing your read and, if you ask for it, emailing it to you. We do not use it to train models, and we do not publish it. If we ever want to use a pitch as an example or as part of a research corpus, we will ask you in writing first, for that specific purpose.

Treat TOM as you would any online service. Leave out trade secrets and anything you could not afford to have leave your hands. Sending a pitch does not create a confidentiality agreement between us beyond what the Privacy notice says.

If you send us a note on how your real pitch went and tick the box that lets us show it, you give us permission to show that note on the site, without your name, until you ask us to take it down. If you send us feedback about TOM itself, we may use it to improve the service without owing you anything for it.

Do not submit anything you are not entitled to submit: someone else’s confidential material, personal information about other people, or anything unlawful. Do not submit the details of a deal you are under an obligation to keep secret.

Fair use of the service

Assessments are offered in good faith and are rate limited. You may not:

We may suspend access that breaks these rules, or that costs us money without producing a pitch.

Our content

The rubric, the checks, the writing, the design and the code of this site belong to TOM PITCH. The dimension names and the check questions are published so you can see what you are being judged on; that is not a licence to copy the service.

Accounts and guest codes

An assessment needs an account. Keep your password to yourself; what happens under your account is yours to answer for. A guest code is for the person it was given to. It works once, it carries a set number of assessments to use within a set number of days, it has no cash value, and it cannot be sold or passed on. We may switch off a code that has not been used.

Paid services

Your first read is free. After that, assessments are sold in packs through our payment processor, Stripe. Every assessment in a pack includes TOM’s score, the checks, the one thing to fix and TOM’s suggestion for the room you chose, and a pack is used within 30 days of its first assessment. The price and what each pack includes are shown to you before you pay, and you agree to these terms before the payment page opens. A pack is a one-off payment; nothing renews. Sessions we run for a programme or a company are covered by the agreement we sign together. Cancellations and refunds are on the refunds page, which forms part of these terms.

No warranty, and what we are responsible for

The service is provided as it is. We do not warrant that a read is accurate, complete or suitable for any particular purpose, and reasonable people will disagree with some of what TOM says. That is the nature of an opinion about writing. To the extent the law allows, we give no implied warranties, including of merchantability, fitness for a particular purpose and non-infringement. The service relies on other companies’ services (hosting, the AI provider, email, and your own browser), and we are not responsible for interruptions or faults in theirs. To the extent the law allows, our total liability to you for anything connected with the service is limited to the greater of what you have paid us in the twelve months before the claim and one hundred US dollars, and we are not liable for lost profits, lost funding, lost opportunities or indirect losses.

Nothing here limits liability that cannot be limited by law.

If your use leads to a claim

If someone brings a claim against us because of what you submitted or because you broke these terms, for example by using a score to screen people, by recording someone without their permission, or by submitting material that was not yours to submit, you agree to cover our reasonable costs of dealing with it, to the extent the law allows.

Changes and ending

We may change the service or these terms; the date at the top changes when we do, and where a change matters we say so on the site. You can stop using the service at any time, and you can ask us to close your account. We may suspend or withdraw access, or switch off an unused guest code, if these terms are broken or if we need to in order to protect the service or other people. The parts of these terms about content, liability and law continue to apply after you stop.

If something goes wrong between us

Write to us first and give us 30 days to put it right. Most things are settled that way.

Law

These terms are governed by the law of the State of California, and the courts of Los Angeles County have jurisdiction, unless the law where you live gives you the right to bring a claim elsewhere.

The rest

If one part of these terms cannot be enforced, the rest still applies. If we do not act on a breach straight away, we have not given up the right to. These terms, with the Privacy notice and the refunds page, are the whole agreement between us about the service. Your account is yours alone and cannot be transferred. We may transfer the service to a successor that takes on these terms.
